38 Studios, the developers responsible for the 2012 RPG Kingdoms Of Amalur, have begun the court case against the state of Rhode Island over a loan of $75 million. The case centers around the claim that the defendants knew the company would fail by the end of 2012, but failed to inform the state of Rhode Island.
Studio founder Curt Schilling, along with 13 others, knew the studio would run out of money by 2012 and be unable to repay the substantial sum of money. The studio secured the loan by promising to bring 450 jobs into the state in a move from Massachusetts to Rhode Island. The loan was given out by the Rhode Island Economic Development Corporation, with some of its members comprising the 14 defendants in the current court case for knowing the company would go bankrupt.
The 14 defendants are attempting for a third time to have the case dismissed, something that the state of Rhode Island isn’t going to let happen anytime soon. The state is also attempting to sell Studio 38’s assets to recoup part of the $130 mil debt that was left in its wake. The two main assets are the IP rights to the Amalur license, and the unfinished MMO project Copernicus.
